In this case, all 65 lawsuits were filed by a single man, Santiago Abreu, a Florida resident who lives with multiple sclerosis and partial paralyzation that forces him to use a wheelchair. Abreu identifies himself as a “tester to discover, encountering, and engaging discrimination against the disabled in public accommodations.” His litigious campaign began in the summer of 2015, with targets ranging from the luxury Broadmoor Hotel in Colorado Springs to fast food restaurants on Colfax in Denver and Breckenridge’s Main Street.
Abreu’s lawsuits accused these Colorado businesses of committing a series of technical ADA violations, which included restroom counters and soda dispensers being placed too high, entryways being too narrow, and—you guessed it—no ADA compliant restroom signs.
Some have criticized Abreu, claiming he and his attorney exploit well-meaning ADA regulations to strong-arm Colorado businesses into paying settlements. Others see Abreu as a champion of the disability movement. Believe it or not, of Abreu’s 65 lawsuits, none appear to have ruled in favor of the business owners!
